TERMS OF SERVICE AGREEMENT

PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY.

This Terms of Service Agreement (the "Agreement") is a binding legal contract between you ("User," "Staff," "Developer," or "You") and Pizza R Us ("Service," "We," "Us," or "Our"). By inviting the Pizza R Us bot to a Discord server, executing a command, joining the Staff Team, contributing code, or otherwise utilizing the Service, you signify your irrevocable acceptance of this Agreement.

IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND MUST DISCONTINUE USE IMMEDIATELY.

1. LICENSE TO ACCESS AND USE

Subject to your compliance with this Agreement, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service strictly in accordance with these Terms. We reserve the right to revoke this license at any time, for any reason, without notice.

2. CENTRALIZED DATA & OPERATION

You acknowledge and agree that Pizza R Us operates on a Centralized Fulfillment Model. By using the Service, you expressly consent to the following:

• Data Transmission: Information regarding orders, user IDs, and server IDs is transmitted from your local server to our Centralized Headquarters ("HQ") for processing.

• Third-Party Processing: Orders are fulfilled by human staff members. You acknowledge that your interaction data is visible to our authorized staff for the purpose of roleplay fulfillment.

• Active Development: The Service is under constant development. Features, commands, and uptime are subject to change without notice.

3. USER CONDUCT & PROHIBITED ACTS

You agree to use the Service only for lawful purposes. You are strictly prohibited from:

• Harassment: Engaging in abusive, threatening, or harassing behavior toward our Staff, Developers, or other Users.

• Disruption: Spamming commands, exploiting bugs, or using automation tools to disrupt the "Centralized Kitchen" operations.

• Reverse Engineering: Attempting to derive source code, trade secrets, or underlying algorithms of the Service.

4. VIRTUAL GOODS & CURRENCY

The Service may include virtual items (e.g., "Pizzas," "Receipts"). These items have no monetary value, cannot be exchanged for legal tender, and are not the property of the User. We retain the right to modify, delete, or reset virtual data at any time.

5. STAFFING, COMPENSATION & VOLUNTEERS

This section governs the relationship between the Service and individuals designated as "Staff" or "Developers."

A. General Staff (Volunteers)

By accepting a role as a Staff Member (including but not limited to Chef, Driver, Moderator, or Manager), you expressly acknowledge and agree that:

1. Volunteer Status: You are providing your services on a strictly volunteer basis for the benefit of the community and your own enjoyment of the roleplay environment.

2. Age Requirement: You represent and warrant that you are at least 16 years of age.

3. No Employment Relationship: No employer-employee, agency, or partnership relationship exists between you and Pizza R Us. You have no expectation of wages, salaries, or benefits.

B. Developers (Commission-Based)

Individuals designated explicitly as "Developers" may be eligible for compensation subject to the following strict conditions:

1. Age Requirement: You represent and warrant that you are at least 18 years of age.

2. Independent Contractor Status: Developers act as independent contractors, not employees.

3. Commission Structure: Compensation is calculated strictly as a Commission. The Service allocates thirty percent (30%) of its Net Income to a shared pool, which is distributed among eligible Developers based on active contribution.

4. Definition of Net Income: "Net Income" is defined as Gross Revenue minus all operational expenses (including but not limited to hosting fees, domain costs, API costs, taxes, and transaction fees).

5. Active Contribution (GitHub): Eligibility for the commission pool is contingent upon Active Contributions. An Active Contribution is determined by the Developer's submission of Pull Requests to the 'DEV' branch on the Service's official GitHub repository. The Administration reserves the right to disqualify spam, low-quality, or invalid Pull Requests from this calculation.

C. Volunteer Incentive Program (Prize Draw)

While General Staff positions are unpaid volunteer roles, Pizza R Us may, at its sole and absolute discretion, conduct a monthly "Staff Appreciation Draw."

1. Eligibility: Only Volunteers deemed "Active" by the Administration during the qualifying month are eligible to enter.

2. The Prize: If a draw is held, a pool equal to ten percent (10%) of the Service's Net Income for that month will be divided equally amongst three (3) randomly selected winners.

3. No Guarantee: This draw is not guaranteed to occur every month. It is a discretionary gratuity, not a wage, salary, or contractual right. If the Service generates no Net Income, or if the Administration chooses not to hold the draw, no prizes will be awarded.

6. GLOBAL SUSPENSION AND TERMINATION

We maintain absolute discretion over who may access the Service.

• Global Ban Authority: We reserve the right to suspend or terminate your access to the Service globally (across all Discord servers) at any time, without notice.

• No Right to Appeal: While we may offer an appeal process, we are under no obligation to reinstate access.

7. INTELLECTUAL PROPERTY

All content included in the Service, including but not limited to text, graphics, logos, software, and code contributions made by Developers, becomes the sole property of Pizza R Us upon creation, unless otherwise specified in a separate written contract.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PIZZA R US, ITS OWNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Pizza R Us from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Service or your violation of this Agreement.

11. SEVERABILITY

If any provision of this Agreement is held to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
